Henry Hill Secures Significant Appellate Victory Before the Dallas Court of Appeals

A recent decision from the Dallas Court of Appeals highlights the importance of understanding the limited circumstances in which prejudgment attachment is available under Texas law.

Henry Hill successfully secured mandamus relief, resulting in the dissolution of a prejudgment writ of attachment involving more than $3.4 million in alleged damages. In its decision, the Dallas Court of Appeals clarified that prejudgment attachment is not appropriate when the underlying claims sound in tort, seek unliquidated damages, and are asserted after a defendant has already been personally served in Texas.

This ruling provides valuable guidance for litigants and reinforces the procedural safeguards that exist to prevent the improper use of prejudgment remedies. It also serves as an important reminder that extraordinary remedies must be applied only within the limits established by Texas law.
